Leave to appeal was granted because Finewood's grounds were not frivolous, there is limited Court of Appeal authority on interim and final prohibitory relief in the context of contracts analogous to personal services, the court had to consider novel issues about the relevance of limitation and exclusion clauses to adequacy of damages (including whether to follow AB v CD), and the importance to Finewood of the issues outweighed the delay of an appeal.
