Security for costs was ordered in the sum of NZD 120,000 (approximately 75% of the estimated incurred and anticipated costs, disbursements and expert fees) to be paid into the plaintiff's solicitors' trust account in two tranches of NZD 60,000 because the plaintiff's offered personal undertaking lacked sufficient evidence of substance and prompt payment and traditional payment into trust best protected the defendant's position under r 5.45(3).
