No serious question to be tried existed as to equitable set-off based on the claimed legal fees given lack of retainer, trust account and supporting records and the Law Society complaint; however an interim injunction was granted because respondents refused to provide particulars of the amount required to redeem the transferred Fico mortgage, and the balance of convenience favored temporary restraint provided applicants pay stipulated interest contributions and respondents disclose mortgage particulars by a set date.
