Access to the agreed summary of facts was granted because the principle of open justice and absence of identified prejudice to the defendant outweighed confidentiality concerns; however access was conditioned to prevent misleading publications by requiring any publication to state that only the facts proved are those set out in the court's judgment, since an agreed summary does not itself prove facts beyond those the judge finds.
