Given the appellant's serious recidivist offending (eighth drink driving conviction), very high breath alcohol reading, additional dangerous driving and assault offending, lack of guilty plea, adverse pre-sentence report and absence of prejudicial systemic delay, the sentencing Judge's starting point, upliftings and global sentence of 18 months imprisonment were within range and not manifestly excessive; refusal of home detention was open to the Judge.
