The Court held there was no arguable error in the District Court Judge's orthodox application of the Evidence Act: the Australian convictions were highly probative given similarity, frequency and lack of collusion and the flight evidence was relevant to consciousness of guilt and to explain delay; any prejudice was not unfair and could be mitigated by directions, so leave to appeal was declined.
