Leave to appeal was refused because the costs issues were pragmatic and largely otiose given events since the District Court decision, any error was speculative or minor, the private interest did not outweigh the cost and delay of a further appeal under s60, and the High Court's discretionary approach to costs (ordering them to lie where they fell) was within legitimate pragmatic exercise of judicial discretion.
