On the evidence (patient history of being pain-free after 2004 surgery, immediate severe pain after the February 2008 fall, MRI and operative findings of a supraspinatus tear, and expert opinion of treating surgeon) the Court found the supraspinatus full thickness tear was caused by the February 2008 accident; accordingly ACC's decision declining funding was quashed and replaced by an entitlement to funding for the surgery.
