The appeal is dismissed because the High Court was satisfied the sentencing Judge did not make a material error: the Judge lawfully exercised discretion by refusing separate remorse credit given established recidivism, appropriately declined an EM-bail credit because the appellant breached EM bail by reoffending, and correctly assessed the pre-sentence report and overall risk to the victim; the end sentence of one year and four months' imprisonment was within range and not manifestly excessive.
