The applications for leave to file out of time, consolidation and adjournment were refused because they were excessively late, would prejudice the scheduled fixture, and the issues in the two proceedings are sufficiently distinct (reinforced by prior pre-trial rulings striking out evidence relevant to the proposed counterclaim), so consolidation and adjournment are not in the interests of justice.
