The Court exercised its discretion to relieve the plaintiffs from the consequences of the unless order because, on the material and submissions, the balance of reasons, attribution of delay and prejudice favoured granting leave; accordingly the plaintiffs named were permitted to adduce the evidence listed in the plaintiffs' schedule and Mr Ronaki was permitted to adduce his brief and cultural report, with timetabled dates set for defendants' responses.
