On balance of the medical evidence the arthroscopic findings and subsequent expert opinion established that the original 1998 injury had resolved and the continuing incapacity was caused by a separate medical joint disease (likely repeated bleeding/arthropathy); therefore ACC properly ceased cover and the appeal must be dismissed.
