The appellant failed to establish on the balance of probabilities the necessary causal link between the alleged failures in treatment or advice and the appellant's developmental delay and epilepsy; available medical evidence and contemporaneous records indicate prematurity and neonatal events, not the alleged treatment failures, are the most likely cause, therefore the treatment injury claim fails and the appeal is dismissed.
