Applicant was entitled to costs on a 2B basis for the successful aspect of her appeal; the claimed quantum was reduced by limiting preparation time to 1.5 days, resulting in an award of $8,059.50 on a 2B basis plus disbursements of $1,443.51.

The Court increased the preparation allowance from 0.75 days to two days at the B rate while otherwise confirming classification 2B because, although the trademark appeal was not especially complex, the extent of submissions and authorities made the higher preparation time reasonable and the initial self-representation was not a material reason to increase costs against the unsuccessful party.

Where two interlocutory applications were heard sequentially within a single half‑day, hearing and preparation time are to be fixed at a quarter day for each application under the High Court costs schedule; costs for a case management conference are payable where the conference dealt solely with matters affecting those interlocutory applications; modest travel and accommodation disbursements claimed were reasonable and payable.
