The respondent's decision was defective because it failed to decide the appellant's specific request that ACC enter into an agreement with his GP to cover interim prescription charges; the Court cannot compel ACC to enter such an agreement but must require ACC to issue a fresh primary decision addressing that request, and the review decision is quashed.

Because the regulatory basis relied upon in Gill (Regulation 10 of the 1999 Regulations) has been repealed and no equivalent is in the 2003 Regulations, an important question of law arises as to whether ACC is now liable to cover 'phone in prescription' costs; the court directs respondent to file submissions on liability under Clause 3(1)(c) of Schedule 1 to the Act.

On a literal reading of the Act and relevant regulations, charges for telephone/fax signing of prescriptions by a GP are not recoverable absent a prior agreement between the Corporation and the treatment provider and are therefore not payable under the existing statutory or regulatory scheme; appeal dismissed.
