Leave to appeal was refused because the Court was satisfied the INZ liaison officer had provided the wife's and children's files to the Tribunal, the presumption that the Tribunal considered material applied, no confirmatory affidavit from the Tribunal was required, and any failure to expressly refer to that material was not material to the outcome; accordingly the s 249B threshold for leave was not met.
