The interim application was dismissed because the applicant lacked a position to preserve and the confiscation of the kettle was justified under Corrections Act s 43(2)(a) as it posed a risk to the applicant and others and engaged the good order condition; accordingly no interim mandatory relief was appropriate against the Crown under s 8(2).
