The High Court held that most of ACC's grounds did not raise questions of law warranting further appeal under s163 but that the discrete question whether "ordinary" in s 32(1)(c) means "more probable than not" (a >50% threshold) is a question of law capable of serious argument and granted leave to appeal to the Court of Appeal on that single question.
