Leave was required because time under r 4.4(2)(a) had expired and the judge, exercising the court's discretion, granted leave to FTL to maintain its third party notices but on conditions because the application was brought late, the proposed claims appeared weak and their joinder would cause prejudice and delay to the plaintiffs.
