The Court reconstituted the purported appeal as an application for judicial review because s 123 of the Human Rights Act 1993 prevents an appeal from interlocutory Tribunal rulings, and judicial review is available in such interlocutory situations to provide an appropriate remedy and to permit the scheduled substantive hearing to proceed.
