At the time of ACC's decision the available medical evidence (notably Mr Welsh’s report) provided a sufficient basis for ACC to be not satisfied the appellant retained a right to ongoing entitlements because the 2011 event showed recovery and no ongoing structural injury; subsequent medical reports did not establish causation from covered injuries sufficient to overturn that assessment and therefore the District Court must dismiss the appeal and uphold the suspension of entitlements.
