The High Court granted special leave because the question whether a s53(2) decision declining compensation for lateness and prejudice is procedural (thus attracting District Court jurisdiction under the 2001 Act) or substantive (thus attracting Authority jurisdiction under the 1982 Act and preserved by s391) raises a bona fide, serious question of law that is of general and public importance and therefore properly determined by the High Court.
