Because the named executor had not proved the will, renounced probate, produced the original will or otherwise acted for an extended period (over two years), the Court exercised its discretion under s6 and r27.25 to appoint an independent professional administrator (Asta Gold) as expedient to ensure proper administration and ordered production of the original will.

Given the delay since death, the absence of the priority applicant seeking appointment, the parties' agreement on a qualified administrator, and the presence of special circumstances under s 6(2) of the Administration Act 1969, the Court will appoint the agreed candidate (Ms Tara Wratten) as administrator, subject to production of the original will or best available copy and filing of the required affidavit.

The Court declined to appoint Robert as administrator because, although he is willing and has relevant background, his longstanding estrangement from the residuary beneficiary (Jatuporn) and her opposition meant appointment would not adequately have regard to her interests and would risk perceived lack of impartiality given pending Family Protection Act claims and disputed share transfers; appointment of Robert was therefore not expedient under s6(2) Administration Act and r27; appointment was deferred and parties directed to confer on an alternative appointment process.
