The proceeding, commenced against a company in liquidation without the liquidator's written consent or the Court's leave under s248(1)(c) Companies Act 1993, is ineffective and must be stayed; the application to join a second plaintiff is denied because joinder would not cure the jurisdictional defect and appears to be an abuse of process, and the plaintiff is additionally precluded from continuing by a prior prohibition order under the Senior Courts Act 2016.
