Medical evidence established that Mrs Simmonds was incapable of managing her affairs; given that incapacity and the consent of beneficiaries and the Public Trust, it was expedient under s 21 of the Administration Act 1969 to remove her as administrator and appoint the Public Trust to enable completion of the property transfer.
