The Court held the District Court did not err in principle or process in declining costs under s 5: investigative shortcomings (lost photographs, disclosure) were insufficiently material to demonstrate lack of good faith or negligence warranting costs, the medical and witness evidence left an arguable case for prosecution, and the discretionary decision was not plainly wrong.
