Leave to appeal was dismissed because there were concurrent factual findings by the High Court and Court of Appeal that the police, not the Crown prosecutor, were responsible for the significant disclosure failings; the proposed appeal would impermissibly challenge those factual findings rather than decide a general question of principle, so it was not in the interests of justice to grant leave.
