The alleged errors were either immaterial to the central issue (whether the complainant asked the appellant to stop and whether he refused) or involved orthodox or necessary directions by the judge; none created a real risk the verdict was affected under s232, and therefore the appeal was dismissed and there was no miscarriage of justice.

Extension of time to appeal granted; appeal dismissed. The contested evidence was admissible or of only marginal relevance, defence strategy had made the behavioural evidence central to the defence, the prosecutor did not unfairly use self‑harm evidence to bolster credibility, jurors could understand ordinary reactions without expert evidence, and omission of a specific cautionary direction did not cause a miscarriage of justice in the circumstances.

The Crown's submission that the appellant's change of account was motivated by knowledge of DNA evidence was supported by subsequent testimony (Mr Morgan) that provided an evidential foundation; adverse comment about the interviewing officer did not produce unfairness given the admitted lie and inconsistent trial evidence; the judge's directions preserved the jury's understanding of the burden of proof, so no miscarriage of justice arose and the conviction stands.
