The Court approved the proposed settlement because, taking a broad view of benefits and detriments under s 64A, the tangible and intangible benefits of finality and removing primary beneficiaries (and in particular Beryl and her children) from long-running family disputes outweighed the speculative financial detriment to minor discretionary beneficiaries; the arrangement was not to their detriment within the s 64A proviso and the trustees' decision falls within their powers and merits the Court's blessing provided prompt implementation.
