The Judge concluded the earlier decision refusing a protective costs order was wrong in light of new evidence of the applicants' inability to bear adverse costs, the Human Rights Commission's intervention demonstrating serious public and human rights importance, the applicants' lack of a material private interest, and access to justice considerations; accordingly the earlier decision was rescinded and a protective costs order was granted on the basis that the applicants will not seek costs if successful (with the court to consider cost-capping only if the applicants later seek costs).
