The claim was struck out because NZTA owed no duty of care to Party Bus in providing audit information to the Ministry given the contractual matrix and public policy concerns — recognising such a duty would cut across the contract and established contract law — and, in any event, NZTA's alleged conduct was not the legal (substantial and material) cause of Party Bus's loss, which flowed from Party Bus's breach and the valid contractual termination.
