Qualified privilege in defamation does not operate as a defence to breach of a protection order; the correct enquiry is whether the appellant had a 'reasonable excuse', and on the facts (egregious content, messages foreseeably forwarded to the protected person, burden on appellant to prove excuse) no reasonable excuse existed, therefore the conviction is upheld.
