Quashing review decision

    Stevens v Accident Compensation Corporation

    Citation
    [2016] NZACC 219
    Court
    District Court

On the evidence and expert input the court accepted the parties’ agreed position: ACC reconsidered and granted cover for cerebral palsy secondary to hypoxic ischaemic encephalopathy resulting from a failure to treat bradycardia (ACR 056/11 discontinued), and the court allowed ACC’s appeal by consent in ACR 185/15 because the dose and administration of pethidine were appropriate, pethidine did not precipitate the bradycardia, and its administration was not contraindicated, therefore the reviewer’s decision was quashed and the Corporation’s earlier decision reinstated.
