The court preferred the specialist orthopaedic opinions over the GP assessor on the balance of probabilities, finding the specialist evidence sufficiently persuasive to establish probable radiculopathy and that the Corporation's vocational independence assessment was therefore wrong; the decision was quashed and remitted for further investigation.
