There was a serious question to be tried and the balance of convenience and overall justice favoured granting interlocutory injunctions restraining use and dissemination of the Stolen Dataset (including against persons unknown), because the public interest did not outweigh the confidentiality and privacy harms; consequently the Court made consent restraining orders with limited carve-outs and transferred the proceedings to the Auckland Registry.
