Application to disqualify Chapman Tripp dismissed: plaintiffs failed to establish a realistic or more-than-negligible risk the firm would be required to defend its own prior legal advice in the substantive proceedings and the asserted divergence of interests between the Body Corporate and committee members was speculative and reliant on an unpleaded basis (Unit Titles Regulations argument raised late); the application was premature and the Body Corporate had independent opinion and a members' vote to retain Chapman Tripp.
