The 1862 Act is repealed and provides no basis to invalidate modern ratings; under the Local Government (Rating) Act 2002 the Council lawfully assessed rates against the applicant as the named ratepayer, a prior rating sale does not prevent future assessments or enforcement, and therefore the rates are valid and enforcement should not be stayed.

Interim relief was refused because the applicant had little prospect of success on the merits, alternative immediate remedies (payment or statutory postponement) were available and unexercised by choice, and there is no legal link between the applicant's demands under the Public Records Act and her obligation to pay rates such that the statutory rating sale process should be halted.

On the evidence the property was never validly transferred to the persons recorded on the valuation roll and there is no basis to order payment to anyone other than the present trustees of the Lila Rosewarne Trust; the trustees and Public Trust must agree the precise amount (allowing for proper costs) and submit a proposed order to the Registrar for sealing.
