There was no evidential support for the purchasers' alleged misrepresentation claim about carparks; the addendum evidenced the purchasers' acceptance that the vendor had been ready, willing and able and accepted validity of the settlement notice; purchasers failed to comply with the settlement notice; accordingly the vendor validly cancelled under clause 10 and is entitled to forfeit the deposit under clause 10.4(1)(b)(i).
