On the facts the Medical Centre operated as the employing authority and Dr Sparks delivered GP services as its agent when consulting and prescribing; those acts were within the Centre's express or implied authority, so the Centre was vicariously liable under s72(3) of the Act; the Commissioner's decision involved no error of law and was not unreasonable.
