The Court held the refinancing evidence was not sufficiently certain or binding (the Kiwibank letter was indicative with conditions and the back‑up was undocumented related‑party finance), given longstanding defaults it was not unreasonable for the mortgagee to proceed; therefore there was no serious question to be tried on oppression and the injunction was dismissed.
