The Court dismissed the adjournment application because the defendants' asserted prejudice was overstated, the defendants had background knowledge and could address new allegations by affidavit, and there was a real risk of economic damage to Sealegs if the hearing were deferred; accordingly the interim injunction hearing was ordered to proceed on 28 October 2016 with specified timetabling directions.
