The recall is dismissed because the provisions now relied on were not of plain relevance and do not alter the outcome given Gilbert J's factual finding that the settlement was not induced by coercive threats; the Court lacks jurisdiction to grant a stay in respect of the High Court s 34 proceedings and, in any event, would not have granted a stay.
