Rule 5.1(5) cannot be applied to allow the commencement of a new proceeding in a different registry for convenience; the rule assumes the proceeding is already filed in its proper registry and permits transfer thereafter, so the application under r 5.1(5) must be dismissed, subject to the court permitting filing in Christchurch if the defendant files a memorandum of consent.
