Because no medical practitioner in Wairoa was willing to examine the appellant and provide the required ACC18 certificate, Gisborne was the nearest place where the appellant could obtain the necessary medical assistance; therefore ACC must reimburse the appellant's travel costs under Regulation 8(2) at the prescribed rate of 29 cents per kilometre.

Regulation 8(2) restricts ACC's liability to travel to the nearest place where the claimant can obtain the required rehabilitation; there is no statutory requirement to obtain an ARC18 from the original treating GP and the applicant did not travel to the nearest provider, so no legal error arises that would support leave to appeal; accordingly leave is refused.

Regulation 8(2) permits reimbursement only for travel to the nearest place where the claimant can obtain the relevant treatment or certification; the appellant travelled to a non-nearest GP when nearer providers existed in Papamoa/Tauranga, therefore ACC correctly declined the transport claim and the appeal is dismissed.
