Reviewer erred in declining jurisdiction to determine backdating of reinstated weekly compensation; on the facts the MRI dated 16 July 2002 provided cogent medical evidence of deterioration and the proper exercise of discretion under s113 was to reinstate weekly compensation from 16 July 2002; appeal allowed on backdating, but the out‑of‑time challenge to the original 2001 work capacity finding was dismissed.
