The Court exercised its s239ADO discretion to extend the voluntary administration because there was a sufficient nexus to the objects of Part 15A (the administrator's report indicated a DOCA would likely provide a better outcome), there was a serious issue to be tried and the balance of convenience favoured preserving the administration to allow related‑creditor challenges under s239AM to be litigated rather than rendered nugatory by an immediate resumption of liquidation; accordingly the administration was extended for a limited period pending determination or further order.
