The High Court held the Family Court must consider the principles derived from the District Court Rules (r 14 series via Family Court Rules r 207) when exercising its costs discretion in PRA proceedings; Judge Goodwin erred by applying an alternative set of factors (Powell v Allison list) as the primary test.
