Leave to appeal was refused because the Court of Appeal correctly held the DNA evidence was relevant despite not identifying the accused, the defence relied on that evidence, the trial Judge gave directions mitigating any prejudicial effect, and the Senior Courts Act criteria for leave (public importance or miscarriage of justice) were not met.
