The oral application to adduce the publications failed because the material that falls within s129 Evidence Act required a formal application to adduce fresh evidence on appeal, the oral application did not meet High Court Rules r7.41 exceptions nor r1.7, admission would be prejudicial and breach natural justice as parties had no reasonable opportunity to respond, the material was reasonably available earlier and contentious so admission would require adjournment and likely turn the appeal into a new case, therefore leave to adduce was refused.
