Although the email omitted material background and was capable of misleading, a reasonable person in the plaintiffs' positions, imputed with the knowledge and advice of their solicitor, would not likely have been misled; accordingly there was no breach of s 9 Fair Trading Act 1986 by the defendant solicitor.
